This Privacy Policy (the “Policy”) explains how Hashi Care(“Hospital”, “Virtual Hospital”, “Hashikesh Healthcare Private Limited”, “we”, “our”, “ours” or “us”) collect, store, use, share and protect your data with regard to your use, access and interaction with our services through our Mobile Application and Website (collectively, “App”). We are committed to protecting your personal data collected by us in accordance with this Policy.

Your use and access of our App will be subject to our Policy, Terms of Use and all the applicable laws (collectively “Applicable Laws”).

1. What does this Privacy Policy cover?

This Privacy Policy covers information regarding our use, storage and treatment of personally identifiable information collected by us during your use and access of our services through the App. We may collect your data directly from you or by using other technologies. Your information may also be collected by third party sites. The information regarding treatment of your data by them is not covered under this Policy. We advise you to check respective privacy policies of the third parties.

2. Use by Children:

Children below the age of 18 are not allowed to use services of this App without supervision of parents. This Policy does not apply to use of our App by children. We recommend parents and guardians to actively monitor the activities of their children and access to their services of this App.

3. Updates or changes to this Policy:

We may, from time to time, make changes and updates in this Policy as we think necessary. However, we will notify you about any such changes and the updated Policy will be posted on our App well as website. We would advise you to check this Policy timely and stay updated about the changes and updates into it.

4. Information we collect:

During your use and access to our services via App, we may collect information about you which can be personally identifiable information. We shall collect your information either directly from you or through tracking technologies to automatically collect your information. However, to the reasonable extent possible, we will inform you about such collection, duration of collection/retention of your data, by whom and for what purposes is this data going to be used. During your use and access to our App, we may collect your information which can be used to identify you personally (“Personal Information”), and information which cannot be used to identify you. (“Non-personal Information).

a. Personal Information:

When you access our App and choose to create account/ log-infor availing Services, we may collect your Personal Information including without limitation your name, address, contact details, email ID, medical history and records, details of past and ongoing treatment, payment details, login details, call records of your interaction with any of our representatives, agents, partners, employees, contractors or affiliates, records of your video consultation. If you are healthcare provider, we may collect your professional details, including without limitation, your qualification, professional skills, certificates, languages known, employment details, choice of locations to serve, address, contact details and ID card etc. We do not collect sensitive information like passwords, your credit/debit card details etc. However, we will take your consent before collecting such personally identifiable information. You will have option to deny from giving us the information. But without certain information, we will not be able to provide all/any of our services to you.

b. Non-personal Information:

During your use and access of our App, we may also collect information other than Personal Information like usage information, duration and frequency of use, pattern of use, IP address, browser details,details of your interaction with us pursuant to services of our App and other data stored in your user account. We may collect and store such information in order to provide you more customized services and improving our services provided through our App or otherwise.

5. Consent:

For the purpose of providing our services to you, we may collect your Personal or Non-personal Information. We will collect your information either directly from you or via tracking tools. However, to the reasonable extent possible, yourconsent will be taken for collecting your information and using the information so collected in accordance with out Terms of Use, Privacy Policy and Applicable Laws. When we ask you for consent to use of your information for secondary purposes like marketing and promotion, we will give you an option to deny to such collection, use or sharing your information by us. You also have right to opt-out from giving us consent for collecting or using your information, use of cookies to track your information.

In addition to purposes mentioned below, we use your information for the purposes including but not limited to providing our services, making improvement in our App and services, and customizing our services in order to provide you an experience with our App as per your expectations and requirements. We may also use your information in any manner, if required, for understanding your requirements, notifying you about our services and protect you against any illegal or fraudulent activities. To the reasonable extent possible, we will notify you and take your consent before using your information other than these purposes. 6.2 To register you as a patient or a service provider on our App;

6.3 To contact you for the purpose of giving you treatment or take follow up;

6.4 To send you notifications and contact you otherwise for marketing and promotional purposes;

6.5 For the purpose of medical or healthcare research in connection with our Service and the App;

6.6 To share information with business partners registered/ not registered with us in order to enable them to provide you required services;

6.7 To take appropriate actions to respond to court orders, process or exercise legal rights of us or any third party;

6.8 To take actions to investigate or prevent illegal activities, fraud or violation of Terms of Use, this Policy and other Applicable Laws;

6.9 To keep records necessary for providing our services and meet other requirements;

6.10 To collect information for keeping records for the purpose of study, research and development and analysis in medical or other health care fields.

6.11 To improve our App or services provided by us.

7. How we share your information:

We do not sell your information collected by us to any third party. We share the information to any third party to make our services available to you according to the Terms of Use, this Policy and all Applicable Laws. We share the information to third parties only when we believe that it is necessary for enabling them to assist us in operating the App and delivering our services to you in the best possible manner. If you are registered as a patient with us, we may share your information with the health-care professionals registered/not registered with us for the purpose of providing you required treatments and services. If you are a professional seeking to provide services through our App, we may share your information with those requiring services from you. We may share your information with our agents, affiliates, associates, partners or employees (collectively “Agents and Affiliates”) in connection with our App and its services. Your information will be shared with our Agents and Affiliates only when their services will be required in connection with our App and Services. We will take all reasonable measures to ensure that the privacy of your information is maintained by such Agents and Affiliates in the best possible manner as required under the applicable laws, rules and regulations.

8. Professionals working with us:

If you are registered with us as a healthcare provider including without limitation to Hospitals, Health Care Institutions & Organizations, Doctors, Nurses, Consultants, Physiotherapists, Counsellors , Paramedical staff, labs, diagnostic centers or other healthcare professional, we will require your information for verification, background checking, your registration on the App . Such details can be including without limitation your educational details and qualification, your professional details, religion, address, contact details, professional licenses, certificates, educational certificates, choice of locations to serve, area of expertise etc. We may also publish some of your details necessary for contacting you on our App to enable patients to view your profiles and contact you in order to avail services of the App. All the provisions relating to collection, use, retention, disclosure and security of personal data are also applicable on your data.

9. Necessary Disclosure of your information:

Subject to the applicable laws, sharing your information in accordance with this Policy also includes disclosing information to third parties when we believe that it is necessary to disclose such information with the third party in order toenforce any agreement, Privacy Policy or Terms of Use, or to protect the rights, interests, safety, and reputation of us, our employees, affiliates, agents, our users or others. We may disclose the information concerning you if we believe in good faith that access, use, preservation or disclosure of the information is necessary to:

9.1 Comply with any applicable law, rules, regulations, legal process or other government inquiry;

9.2 Enforce our Terms of Use and Privacy Policy or take action against any violation of rights of any party;

9.3 Detect, Prevent, or otherwise address fraud, security or technical issues;

9.4 Protect our rights, reputation, and property, or that of our users, affiliates, or the public.

10. Retention of your data:

We will keep your information stored with us including without limitation your personal information, work records and your medical history as long as you are using our app and availing our services in any manner. In some cases, we will keep your information with us for longer period than mentioned above for medical or healthcare study, medical- healthcare research and analysis, treatment records or other similar purposes. Also, when you delete your account maintained with us, it is not necessary that the information which you provided at the time of registration of the account will be deleted. We shall retain your data as long as it is reasonably necessary for providing and improving our services in accordance with all the Applicable Laws. However, you reserve right to erasure, through which you can request and get the data concerning you deleted from our databases in accordance with Applicable Laws.

11. Cookies and other tracking tools:

We use cookies and other tracking technologies on our App. Cookies are used for tracking information like user preference, user activities on our App and your interaction with our App. Cookies will not collect any sensitive data. However, we will give you option to either allow or block these cookies. You also have right to opt-out from giving consent for using cookies if you have already consented for the same.

12. Third party websites:

This Privacy Policy applies to the App and Services owned and operated by us. During use of the App and these Services, you may come across several links which will lead you to third party websites. Once you leave our servers, we are not liable for collection and usage of your data or cookies placed by them. They have their own privacy policies to govern treatment to your personal data by them. We encourage you to read policies of respective third party for knowing how they collect and use your information.

13. Security:

We are concerned about security of your information. We have adopted reasonable security practices and procedures to protect your information. We take strict security measures to ensure that your personal information is not damaged, destroyed or disclosed to any third party unless with your consent or if necessary as per this Policy, Terms of Use and Applicable Laws, rules and regulations. We are taking all the possible measures to ensure that your personal information collected by us is secured from unauthorized access, improper use or disclosure, unauthorized modification or accidental loss. We have also restricted access to this information to our employees, agents, third party service providers, affiliates and partners as required in accordance with this Policy. However, we cannot give you guarantee as to 100% security of your information due to unpredictable consequences of use of internet. We will not be responsible for any unintended damage, loss or disclosure of your data.

14. Your rights regarding your Personal Information:

14.1 You have right to access with regard to your personal information stored with us. You can know what information concerning you is stored with us and whether your personal information is being processed. You can also request for a copy of the information concerning you held with us by sending an email to the e-mail ID mentioned in ‘Contact Us’ section below.

14.2 You can have your personal data erased/deleted. If you wish to delete or in any way dispose of all or any part of your information held with us, you can send us an e-mail at the e-mail ID given in ‘Contact us’ section below. We will respond to your queries and take necessary action in accordance with Applicable Laws.

14.3 If your data held with us is inaccurate or incomplete or needs to be changed, you can update, change, modify or complete your information held with us. For rectifying or updating your information, you can contact us at e-mail ID given in ‘Contact Us’ section below and we will take necessary action according to your requirement.

14.5 You are entitled to request copies of your data in standardized and readable format to have your data transferred to database of data processor/controller of another organization by sending the request to usvia e-mail.

14.7 You can object to the processing of your data by us at any time if you believe it to be against your legitimate interest. You can object to the processing by sending us an e-mail provided in ‘Contact us’ section below.

While our Policy covers your rights, please keep in mind that all the rights are subject to certain restrictions including but not limited to purposes of safeguarding public interest and legitimate interest of any other party.

15. Payment Information:

We collect information relating to payment made or to be made by you in connection with our App only to the extent necessary for keeping records and enforcing our rights to receive payments. We do not collect sensitive information like passwords and OTPs, other details of credit/debit card used by you for the payment.

16. Notification of breach:

We will inform you and the required relevant authorities about such breach within 72 hours on becoming aware about any data breach concerning your information.

The Mobile/Tablet Application ‘Hashi Care’ and website www.hashicare.com (collectively referred to as “App”) are owned by Hashikesh Healthcare Private Limited(“Owner” or “Hashi Care”).

‘Hashi Care’ is a platform that allows and enables users to access and avail various health care services provided by various health care providers, including without limitation, doctors, nurses, para medicals, pathology labs, diagnostic centers, ambulance, blood banks, pharmacies, medical tourism service providers (“Healthcare Providers”). The Health Care Services include without limitation providing information about Healthcare Providers and their services, responding to inquiries, booking consultations with health care providers, facilitating consultation and communication between the Healthcare Provider and patient/user, taking appointments with pathologies, labs or diagnostic centers, uploading of reports, ordering medicines from pharmacy, making payment for the services rendered, contacting ambulance, hiring care providers etc. (“Services”). The services are offered in variety of ways and modes. All the information regarding the services offered is available on the App. If you have any question related to the services offered, you contact at the contact details given in these Terms.

1. Scope of Terms:

Please carefully go through these Terms and Conditions of Use (“Terms”) and the Privacy Policy available at Privacy Policy link (“Privacy Policy”) before you decide to access the App or avail the services made available on the App. By agreeing to use the App, you also agree to be bound by our Privacy Policy and the rules, guidelines, and policies as are relevant under the applicable laws in India and other jurisdictions for the purposes of accessing, browsing or transacting on the App.

This Terms will be applicable on you whether you are:

(a) A Healthcare Provider wishing to be listed or already listed on the App; or

(b) A patient, his/her representatives or affiliates, looking for any Healthcare Provider; or

(c) Otherwise a user of the App.

(All of the above are collectively and individually referred to as “User” in the Terms)

The terms 'You' or 'Your' refer to you as the User irrespective of whether you are a registered user or a non-registered user and the terms 'Owner','We', 'Us', 'Our', ‘App’, ‘Hashi Care’ refer toHashikesh Healthcare Private Limited. By accessing or using the Services, you signify that you have read, understood, and agree to be bound by these Terms and to the collection and use of your information as set forth in the Privacy Policy.

[Owner/App and User are referred to in the Terms individually as “Party” and collectively as “Parties”.]

2. Users:

The App is accessible to registered and non- registered users. "Non-Registered Users" are users who are not registered with the App but who can access certain information available on the App. "Registered Users" are users who have registered themselves and have an account on the App by providing to us certain information and who can log in to the App by providing their username and password or OTP. Please note that certain features and services of the App are available only to the Registered Users.

3. Conditions of Use:

You must be 18 years of age or older to register, use the Services, or visit or use the App in any manner. By registering, visiting and using the App or accepting this Agreement, you represent and warrant to us that you are 18 years of age or older, and that you have the right, authority, legal and mental capacity to use the App and the Services available through the App and to agree to abide by the Termsand not prohibited by applicable law or us from accessing or using the App or Services.

We may review and update the Terms at regular intervals. It is your responsibility to review the Terms periodically. If at any time, you find any or all of the Terms to be unacceptable or do not agree with the Terms, please do not use this App.

4. User Data:

A. You may need to provide your information in order to avail various services provided by the App including without limitation, consultation with Healthcare Providers through App, uploading medical test reports, providing details relating to medical condition to find appropriate Healthcare Provider. This information can be your personal information. By using our App, you authorize us to use your information for the purpose of providing our services to you. In addition to your personal information like name, age, contact details, health information, we may also collect information relating to the devices through which you access the App and anonymous data of your usage. The collected information will be used only for providing you requisite services, improving the quality of our services and to build new services. Please read our “Privacy Policy” for more information on this.

B. We respect the privacy of your information and take all reasonable steps to maintain the privacy and confidentiality of your information. We shall not intentionally or unless required under the law, share any of your personal information with any third party. However, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures or use your personal information for improper or unauthorized purpose.

C. Hashi Care shall not be responsible in any manner whatsoever for the authenticity or accuracy of the personal information or sensitive personal data or information supplied by the User to the App, any other person acting on behalf of App or to the Healthcare Provider. If a User provides any information that is untrue, inaccurate, incomplete or not current (or becomes untrue, inaccurate, not current or incomplete), or if Hashi Care has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Hashi Care has the right to discontinue the Services to the User at its sole discretion. Also, you must understand that the Services provided to you by any Healthcare Provider may be based on the information provided by you. If you suffer from any kind of loss or inconvenience due to your failure to provide true, accurate, complete information, Hashi Care will not be responsible in any manner whatsoever to you or Healthcare Provider or any other party.

D. The User is responsible for maintaining the confidentiality of the User’s account access information and password, if the User is registered on the App. The User shall be responsible for all usage of the User’s account, OTP and password, whether or not authorized by the User. The User shall immediately notify Hashi Care of any actual or suspected unauthorized use of the User’s account or password. Although Hashi Care will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses to the Hashi Care due to any unauthorized use of your account.

E. User should not transfer (including by way of transfer, assignment, license, sublicense) their User name or account access information or their right to use service to any third party. However, if the User does so, the User will solely be responsible for the way anyone the User has authorized to use the service uses the Services, and for ensuring that all of such users comply with all of the terms and conditions hereto. Any violation of the Terms by any such user shall be deemed to be a violation thereof by you.

F. You undertake and confirm that your registration details, including your name, date of birth, gender, phone number, family information, health records including weight and height, personal information and email address or any other information provided by you for availing the Services, are true and accurate at all times and you undertake to update your registration details from time to time. If we become aware that the information provided by you is incorrect or false, we reserve the right to immediately cancel your registration and acceptance for registration in the future will be at our discretion.

G. Further, App may also send notifications and reminders to you with respect to bookings done or appointments scheduled by you and for the features that you may be using on the App. You hereby consent to receive such messages/emails from us. You also consent to receive communications including promotional content from Us.

5. Listing Information:

The App will display relevant information about Healthcare Providers, their profiles, qualifications, prescribed fees, contact details and various other information about them (“Listing Information”). These listings do not represent any fixed objective ranking, preference or endorsement by the Hashi Care. We do not endorse or influence control over any particular branch of medicine, theory, opinion, viewpoint or position on any topic. Hashi Care will exercise all reasonable care to ensure that the information provided in and in relation such listings is true, authentic, complete and accurate at all times. However, the Hashi Care shall not be held liable for any inaccuracies or incompleteness represented in the Listing Information despite such reasonable efforts.

6. Service Booking:

To enable you to book an appointment or services with Healthcare Provider, the App will provide you with the listings of Health Providers who may be suitable to provide you the services that you are looking for based on the information that you provide to the App including without limitation, specialty of medical professional, geographical location. From among the listings, you will need to select one. However, the listings shall be displayed and booking shall be confirmed as per availability and the App reserves the right to schedule/reschedule/cancel all such bookings and provide notification for the same.

7. Appointment:

The App provides the facility of booking an appointment with various Healthcare Providers like Doctors, Labs, and Diagnostic Centers. The App will take all reasonable measures to ensure that the User gets a confirmed appointment. However, subject to the provisions of these Terms,Hashi Carewill have no liability towards the User or any other party if such an appointment is later cancelled by the Healthcare Provider with or without notice to the User, or if the Healthcare Provider is not available at the time or place of the appointment.

No Show by User:

In the event where the User who has booked an appointment with any Healthcare Provider does not turn up at the agreed upon time and/or place without informing the Healthcare Provider in advance or cancelling or rescheduling the appointment will be considered as a ‘No Show by User’ incident. If the User does this for more than three times, Hashi Care will have a discretion to temporarily suspend or disable the User’s account and/or the services provided by the App to the User. When the Owner decides to suspend or disable User’s account and/or the services to User, the User will have an opportunity to explain to Hashi Care the reasons behind not showing up on the appointment place and/or time. User can contact Hashi Care through contact details provided in the App and this Terms for the same. After hearing the side of the User, it will be Hashi Care’s discretion to decide whether to continue with such suspension or remove it. In case where the suspension or disablement as mentioned in this provision is inflicted, it will be for the duration as may be decided by Hashi Care in their sole discretion. If the User faces any kind of claim, suit, or loss due to not showing up at the appointment place and/or time from the Healthcare Provider or any third party, Hashi Care will not have any responsibility towards the User or any other party.

8. Cancellation and Refund:

A. In the event where the Healthcare Provider cancels the appointment for which the User has paid the booking amount through the App, User will need to write to us on the contact details mentioned below in the Terms within three business days from the day of such cancellation of booked appointment. Hashi Care will look into the claim and if the incident described by the User is true then Hashi Care shall refund the booking amount paid by User through the App within next ten business days.

B. Users will not be entitled for any refunds in cases where, the Healthcare Provider is not able to meet the User at the exact time of appointment and requires the User to wait for a couple of hours not exceeding three hours, irrespective whether the User is required to wait or choose to not obtain the services from the said Healthcare Provider.

C. In case where the User does not show up for the appointment booked with the Healthcare Provider without cancelling the appointment beforehand, the booking amount will not be refunded, and it will be treated as ‘No Show by User’.

9. Limited Liability of the Owner:

The App is basically a platform connecting Users with the Healthcare Providers. The listings mentioned on the App are solely for the informational purposes of User. The App does not endorse any Healthcare Provider. When the User decides to avail the services of any Healthcare Provider or engage in any communication with any Healthcare Provider, the User does it at his/her own risk. The App is not involved in providing any healthcare service, medical advice, opinion or diagnosis. Hashi Care is merely a service facilitator and hence, is not responsible for any interactions between User and the Healthcare Provider.

Though Hashi Care takes all reasonable measures to ensure that the Healthcare Providers listed on the App are genuine and qualified, it is hereby agreed and understood that Hashi Care cannot be held liable towards any party for any or all of the following situations:

A. User’s communication or interaction with the Healthcare Provider and all situations and consequences thereto;

B. The efficiency or lack of efficiency of the Healthcare Providers in performing their Services for the Users;

C. The quality of the services given to the User or any case of negligence by the Healthcare Provider;

D. The intention or motive of Healthcare Provider in giving any opinion, suggestion, advice, treatment or any other service to the User;

E. Failure of the Healthcare Provider to provide agreed services or to provide services at agreed time and place;

F. Any inconvenience, disturbance, loss suffered by the User during the course of consultation, treatment or during the Healthcare Provider’s performance of services;

G. Effects or consequences on User’s health of any treatment, diagnosis, consultation, medicines or any other service provided by the Healthcare Provider;

H. Any misconduct, misbehavior or negligence by Healthcare provider;

I. Any breach of any applicable laws, rules, regulations by the Healthcare Provider;

J. Cancellation of appointment or no show on appointment time by the Healthcare Provider;

K. Charging of higher fees or any variation in charging of fees from what has been indicated by them on the App.

10. General Information on App not Medical Advice:

The information, content, suggestions, opinions, advice, guidance or other material generally provided or available on the App except the User’s personal interaction with the Healthcare Provider on his/her specific medical condition may be general in nature and may not accurately fit the specific circumstances or conditions of any individual. Such information is only given to assist you to find appropriate care and/or Healthcare Provider. Please note that such information provided on the App does not constitute an opinion, medical advice, or diagnosis or treatment of any particular condition. The provision of such information on the App or your use of the App does not create any sort of Patient- Medical professional relationship or privilege between the App and the User.

It is hereby expressly clarified that, the Information that you obtain or receive from Hashi Care, and its employees, contractors, partners, sponsors, advertisers, licensors or otherwise on the App is for informational purposes only. We make no guarantees, representations or warranties, whether expressed or implied, with respect to professional qualifications, quality of work, expertise or other information provided on the App. In no event shall we be liable to you or anyone else for any decision made or action taken by you in reliance on such information.

11. Area of Operation:

App may provide its services only for certain or limited cities or areas. The information relating to the areas for which the services of the App are available will be mentioned on the App. The App may add, remove or change the areas for which it provides its services in its own discretion at any time with or without notice. The App will not be responsible to you for any loss or inconvenience caused to you due to such change or removal of any area by the App.

12. Emergency Situations:

Our services are not a replacement to emergency services offered at hospitals and are not applicable if the patient is in a critical or unstable state. In case of emergency, please contact emergency services and/or rush to nearest hospital. All charges and costs towards emergency treatment to be borne by the patient.

13. Legal Compliance:

A. We will take all reasonable steps to ensure that our services are in compliance with all central and state government regulations and directives of the health ministry, Indian Council of Medical Research guidelines, the Medical Council of India, State Council, Dental Council of India, Physiotherapy Council of India and Indian Nursing Council guidelines as applicable from time-to- time. However such guidelines/directives/rules/laws from such authority/organization/institution are indicative in nature and not exhaustive. Also for App’s service of providing care providers like nurse, para medical, attendants, we will conduct appropriate background and reference checks of the care providers. If we find any problem with the background of such care provider which in our opinion may be adverse to the interests of the User, we will promptly inform the User. However the results of such verification reports are confidential and accessible only to owner and its internal staff and will not be shared with User.

B. To the extent permissible under applicable laws, despite exercising all reasonable care with regard to compliance with applicable laws, rules, regulations, if the User suffers any harm, loss or inconvenience, Hashi Care shall not be held responsible.

14. User’s Obligations:

The User agrees to abide by the following obligations. Failure to satisfy any of these obligations gives us the right to permanently suspend your account and/or claim damages for any losses that accrue to us or additional costs that may be imposed on us. You agree to comply with all applicable laws and regulations governing the downloading, installation and/or use of the App, including, without limitation, any usage rules set forth in the Terms.

You agree not to:

A. Cut, copy, paste, distribute, sell, modify, recreate, reverse engineer, post, publish or create derivative works from, transfer any information or software obtained from the App. If you want to engage in one or more such actions, prior permission from Us must be obtained.

B. use the App in any manner that may impair, overburden, damage, disable or otherwise compromise the services of the App.

C. use the App, services provided through the App, User information made available through App, or any information , material or content available on the App for any unlawful purposes or to conduct or to participate in conducting any unlawful activity, including, but not limited to, fraud, misrepresentation, cheating, defamation, money laundering or identity theft.

D. access or attempt to access the App and/or the materials or Services by any means other than through the interface that is provided by the App. The use of deep-link, robot, spider or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Application or Content, or in any way reproduce or circumvent the navigational structure or presentation of the App, materials or any Content, to obtain or attempt to obtain any materials, documents or information through any means not specifically made available through the App is prohibited.

E. use the information, content or material made available through App to abuse, harass, threaten, defame, disillusion, demean or otherwise violate the legal rights of others.

F. engage in any activity that interferes with or disrupts access to the App or the Services or the servers and networks which are connected to the App.

G. engage in any form of antisocial, disrupting, or destructive acts, including "flaming", "spamming", "flooding", "trolling", "phishing' and "griefing" as those terms are commonly understood and used on the Internet.

H. violate any applicable laws or regulations for the time being in force within or outside India.

I. violate any code of conduct or other guidelines, which may be applicable for or to any particular Service.

J. host, display, upload, modify, publish, transmit, update or share any information that: (i) belongs to another person and to which the user does not have any right; (ii) is harmful, harassing, defamatory, obscene, pornographic, pedophilic, invasive of another's privacy, hateful, objectionable, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatsoever; (iii) infringes any intellectual property right or proprietary right of any person; (iv) untrue or inaccurate in nature; (v) contains viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; (vi) threatens the unity, integrity, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any offence or prevents investigation of any offence or is insulting any other nation; (vii) violates any applicable law; (viii) impersonates others.

K. Owner, upon obtaining knowledge by itself or through any other source, shall be entitled to disable such information that is in contravention of this Terms. If we suspect any illegal, wrongful or fraudulent activity on the App by any User or Healthcare Provider, notwithstanding any other rights We may have, We reserve the right to inform the relevant government or law enforcement authorities. We will cooperate in all investigative procedures or requests for access / information initiated by any such government or law enforcement authorities.

15. Intellectual Property Rights:

A. All rights, claims, title and interest in and to the materials provided on this App, including but not limited to information, marks, documents, logos, graphics, sounds and images (the "Materials") are either owned by us or validly licensed to us or otherwise used by us as permitted under applicable laws. Through Your use of the App, by no means are any rights impliedly or expressly granted by us to you in respect of such material.

B. App and/or its licensors assert all proprietary rights in and to all names, trademarks and other intellectual properties contained on the App. Any use of our trademarks, copyright or any other intellectual property, unless otherwise authorized in written, will constitute an infringement of our trademark or copyright or any other such intellectual property right and may be actionable under the applicable laws.

C. Except as stated otherwise in the Terms all Content of App \ (including all intellectual property rights to such content) is owned exclusively by us and/or our licensors. When You use the App in accordance with this the Terms, a limited royalty-free right is granted to you by us to use the App’s content for personal and non-commercial use for the time that you are either a registered user or Healthcare Provider or for the time that You make use of the App, whichever is less. Unless explicitly stated herein, nothing in the Terms shall be construed as conferring on you any license to intellectual property rights, whether by estoppel, implication, or otherwise.

D. User Content: You agree that you are the owner of all rights including all intellectual property rights in the User Content (in case you are a Registered User) or Health Provider Content (in case you are a Healthcare provider) that you post on the App or provide to us. You hereby grant us a perpetual, non-revocable, worldwide, royalty-free license to make use of such User Content (in case You are a Registered User) or Health Provider Content (in case you are a Healthcare provider) including the right to copy, distribute, display, reproduce, modify, adapt, the User Content or Health Provider Content, as the case may be, and create derivate works of the User Content or Health Provider Content, as the case may be.

16. Disclaimers:

In addition to the limitations on liability of Owner as mentioned in other provisions of the Terms, it is hereby understood and agreed that the Owner disclaims any and all responsibilities or liabilities towards User or any third party in following situations:

A. We make no guarantees, representations or warranties, whether expressed or implied, with respect to professional qualifications, quality of work, expertise of the Healthcare Provider. The search results are based on an object computer algorithm.

B. We shall not be responsible for any breach of service or service deficiency by any Healthcare Provider.

C. We can neither assure that all transactions on the App will be completed nor do we guarantee the ability or intent of Healthcare Provider to fulfill their obligations in any transaction. We advise you to perform your own investigation prior to selecting any Healthcare Provider or Services.

D. To clarify, you understand and agree that any interactions and associated issues with the Healthcare provider(s) on the App, is strictly between you and the Healthcare Provider. You shall not hold us responsible for any such interactions and associated issues. We are not involved in the providing any healthcare or medical advice or diagnosis and hence are not responsible for any outcome between You and the Healthcare Provider You interact with. If you decide to engage with a Healthcare Provider to provide medical services to you, you do so at your own risk.

E. We may provide information to assist you in decision-making. The information and materials available through the App are for informational and educational purposes only and are not intended to constitute professional advice, diagnosis or treatment, or to substitute professional judgment. We are not responsible for the accuracy or completeness of information available from or through App. You assume full risk and responsibility for the use of information you obtain from or through this App, and You agree that we are not responsible or liable for any claim, loss, or liability arising from the use of the information. We do not recommend or endorse any Healthcare Provider or health-related products, items or services, and the appearance of materials on the App relating to any such products, items or services is not an endorsement or recommendation of them.

F. Information regarding Healthcare Provider and practice information found on the App is intended for general reference purposes only. Such information found on the App is mainly self-reported by the Healthcare Provider. Such information often changes frequently and may become out of date or inaccurate. We do not provide any advice or qualification certification about any particular Healthcare Provider. You are encouraged to independently verify any such information you see on the App with respect to a Healthcare Provider that you seek to avail services of.

G. If You rely on any of the Information provided by App, You do so solely at your own risk. The Information that you obtain or receive from Owner, and its employees, contractors, partners, sponsors, advertisers, licensors or otherwise on the App is for informational and scheduling purposes only. In no event shall We be liable to you or anyone else for any decision made or action taken by you in reliance on such information.

H. You acknowledge and confirm that we shall not be responsible for your treatment or provision of services by Healthcare Provider in any manner whatsoever.

I. We disclaim any representation and/or warranty for the security, reliability, quality, timeliness, and performance of (i) the App and its features; (ii) Healthcare Provider who responds to question of the User or who interacts privately with a User; (iii) any information, content or advice available on or received through the App (iv) access to or alteration of User content or Healthcare Provider content (v) transmissions or data and (vi) the accuracy of any content of User’s test reports or diagnosis(vii)any other matter relating to the App

J. We make no warranty or representation that any errors in the App will be corrected except as required by law.

K. We assume no responsibility and/or liability with respect to any user content, or Healthcare Provider content (as applicable) or for the consequences of you reading or relying on such content.

L. The App is provided on a "As is" and "As Available" basis. we are not liable for any technical or other operational difficulties or problems which may result in loss of your data, personalization settings or other interruptions in the features offered on the app. we are not liable for the deletion, loss, mis-delivery, timeliness or failure to store or transmit any user content or healthcare provider content, app content or your personalization settings.

M. We do not provide any guarantee and shall not be held liable or responsible for the failure to send sms or other notifications or reminders to you as a feature of the App.

N. We shall not be responsible or liable for any breach or loss of data including Personal Information caused due to events beyond our control or due to technical reasons or third party actions.

O. You acknowledge, by Your access of the App, that Your access of the App and availing of Services is at Your sole risk and You assume full responsibility for Your access and use of the App, and that Hashi Care shall not be liable for any damages of any kind related to Your access and use of them App

17. Limitation of Liability:

To the fullest extent permitted by law, in no event will Owner or its affiliates be liable for any direct, indirect, special, incidental, punitive, exemplary or consequential damages, whether or not Owner has been warned of the possibility of such damages or could have reasonably foreseen such damages.

18. Indemnification:

You hereby agree to indemnify, defend, and hold Owner and/or its affiliates, officers, directors, owners, employees, agents, representatives, harmless from and against any and all losses, damages, liabilities and costs arising from (i)Your use of the App (ii) Your breach of provisions of this Terms and (iii) any negligent or intentional wrongdoing on Your part.

19. Modification

A. We may review and update the Terms at regular intervals. It is your responsibility to review the Terms periodically. If at any time, you find any or all of the Terms to be unacceptable or do not agree with the Terms, please do not use this App. If you have any question or query related to the Terms, you can contact us at the contact details provided below in these Terms.

B. We reserve the right at any time to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. You agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

20. Termination:

We reserve the right, in the event we find out in our sole discretion that you breached the Terms, to suspend and / or terminate your user account and/or access to the Appwith or without notice to you. Any suspected illegal, fraudulent or abusive activity may be grounds for suspending and / or terminating your user account and/or your access to the App.

Upon suspension/termination of User Account and/or access to the App, regardless of the reasons therefore, your right to use the App and content and services thereof immediately ceases, and you acknowledge and agree that we may immediately deactivate or delete Your account and all related information and files in your account and/or bar any further access to such files or this App. We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension of your user account or any other actions taken by us in connection with such account termination or suspension.

21. Right to refuse Services:

Nothing in these Terms will be deemed to require us to perform any services which in our good faith judgment would be misleading, false, unlawful, inappropriate, immoral, in breach of a contract, or otherwise prejudicial to App’s interests. You acknowledge that we reserve the right to refuse service to anyone and to cancel Users' access to the App, for any reason and at any time with or without prior notice.

22. Complaints regarding Intellectual Property:

We respect the Intellectual property Rights of others. If you have a good faith belief that any information or content on the App is infringing on your copyrights, trademark rights or other intellectual property rights, you must notify us at the contact details given below in these Terms. We will look into the issue promptly and take necessary steps, if required.

23. Third Party Links:

You may be provided with links on the App that direct you to third party websites / applications / content or service providers (collectively "Third Party Websites"). We do not endorse any Third Party Websites that you may be directed to from the App. Links to such Third Party Websites are provided for your convenience only. Please exercise your independent judgment and prudence when visiting / using any Third Party Websites via a link available on the App. If you decide to click on the links to visit such Third Party Website, you do so at your own risk. Your usage of such Third Party Websites and all content available on such Third Party Websites is subject to the terms of use of the respective Third Party Website and we are not responsible for your use of any Third Party Websites.

24. International Users:

The App is operated from our offices within India. If you access the App or Service from a location outside India, you are responsible for compliance with all local laws. You agree that you will not use the App or services and content thereto in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

25. Dispute Resolution:

If any dispute or disagreement arises out of or in connection with App, its services or these Terms, the Parties shall try to resolve it through fair and amicable negotiations. If it is not possible to resolve the disputes inter se, then both the Parties agree to resolve it through mediation proceeding. The mediation proceeding shall be conducted in Ahmedabad, Gujarat, India. If the dispute or disagreement cannot be resolved through mediation also, then the dispute shall be resolved through court proceedings subject to jurisdiction of Ahmedabad, Gujarat, India.

26. Severability:

If any provision of the Terms is held to be invalid, illegal or unenforceable in whole or in part for any reason, the remaining provisions shall not be affected and shall continue to be valid, legal and enforceable as though the illegal, invalid, unenforceable parts had not been included in the Terms. If a court of competent jurisdiction finds any provision of the Terms to be invalid or unenforceable, but if by limiting such provision it can become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

27. Heading:

Headings used in the Terms are provided for convenience only and shall not be used to construe meaning or intent.

28. Waiver:

Our failure to enforce any provision contained in the Terms is not a waiver of our right to do so later.

29. Assignment:

User may not assign any of its rights under these Terms, and any such attempt will be void, unless prior written consent exists on behalf of Owner. We may assign our rights to any affiliates or subsidiaries, or to any successor in interest of any business associated with the Services.

30. Force Majeure:

You accept and acknowledge that we shall not be liable for any loss or damage caused to the User as a result of delay or default or deficiency or failure in the Services as a result of any natural disasters, fire, riots, civil disturbances, actions or decrees of governmental bodies, communication line failures, or any other delay or default or deficiency or failure which arises from causes beyond our reasonable control (“Force Majeure Event”).

The Mobile/Tablet Application ‘Hashi Care’ and website www.hashicare.com (collectively referred to as “App”) are owned by Hashikesh Healthcare Private Limited(“Owner” or “Hashi Care”).

‘Hashi Care’ is a platform that allows and enables users to access and avail various health care services provided by various health care providers, including without limitation, doctors, nurses, para medicals, pathology labs, diagnostic centers, ambulance, blood banks, pharmacies, medical tourism service providers (“Healthcare Providers”). The Health Care Services include without limitation providing information about Healthcare Providers and their services, responding to inquiries, booking consultations with health care providers, facilitating consultation and communication between the Healthcare Provider and patient/user, taking appointments with pathologies, labs or diagnostic centers, uploading of reports, ordering medicines from pharmacy, making payment for the services rendered, contacting ambulance, hiring care providers etc. (“Services”). The services are offered in variety of ways and modes. All the information regarding the services offered is available on the App. If you have any question related to the services offered, you contact at the contact details given in these Terms.

1. Scope of Terms:

Please carefully go through these Terms and Conditions of Use (“Terms”) and the Privacy Policy available at Privacy Policy link (“Privacy Policy”) before you decide to access the App or avail the services made available on the App. By agreeing to use the App, you also agree to be bound by our Privacy Policy and the rules, guidelines, and policies as are relevant under the applicable laws in India and other jurisdictions for the purposes of accessing, browsing or transacting on the App.

This Terms will be applicable on you whether you are:

(a) A Healthcare Provider wishing to be listed or already listed on the App; or

(b) A patient, his/her representatives or affiliates, looking for any Healthcare Provider; or

(c) Otherwise a user of the App.

(All of the above are collectively and individually referred to as “User” in the Terms)

The terms 'You' or 'Your' refer to you as the User irrespective of whether you are a registered user or a non-registered user and the terms 'Owner','We', 'Us', 'Our', ‘App’, ‘Hashi Care’ refer toHashikesh Healthcare Private Limited. By accessing or using the Services, you signify that you have read, understood, and agree to be bound by these Terms and to the collection and use of your information as set forth in the Privacy Policy.

[Owner/App and User are referred to in the Terms individually as “Party” and collectively as “Parties”.]

2. Users:

The App is accessible to registered and non- registered users. "Non-Registered Users" are users who are not registered with the App but who can access certain information available on the App. "Registered Users" are users who have registered themselves and have an account on the App by providing to us certain information and who can log in to the App by providing their username and password or OTP. Please note that certain features and services of the App are available only to the Registered Users.

3. Conditions of Use:

You must be 18 years of age or older to register, use the Services, or visit or use the App in any manner. By registering, visiting and using the App or accepting this Agreement, you represent and warrant to us that you are 18 years of age or older, and that you have the right, authority, legal and mental capacity to use the App and the Services available through the App and to agree to abide by the Termsand not prohibited by applicable law or us from accessing or using the App or Services.

We may review and update the Terms at regular intervals. It is your responsibility to review the Terms periodically. If at any time, you find any or all of the Terms to be unacceptable or do not agree with the Terms, please do not use this App.

4. User Data:

A. You may need to provide your information in order to avail various services provided by the App including without limitation, consultation with Healthcare Providers through App, uploading medical test reports, providing details relating to medical condition to find appropriate Healthcare Provider. This information can be your personal information. By using our App, you authorize us to use your information for the purpose of providing our services to you. In addition to your personal information like name, age, contact details, health information, we may also collect information relating to the devices through which you access the App and anonymous data of your usage. The collected information will be used only for providing you requisite services, improving the quality of our services and to build new services. Please read our “Privacy Policy” for more information on this.

B. We respect the privacy of your information and take all reasonable steps to maintain the privacy and confidentiality of your information. We shall not intentionally or unless required under the law, share any of your personal information with any third party. However, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures or use your personal information for improper or unauthorized purpose.

C. Hashi Care shall not be responsible in any manner whatsoever for the authenticity or accuracy of the personal information or sensitive personal data or information supplied by the User to the App, any other person acting on behalf of App or to the Healthcare Provider. If a User provides any information that is untrue, inaccurate, incomplete or not current (or becomes untrue, inaccurate, not current or incomplete), or if Hashi Care has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Hashi Care has the right to discontinue the Services to the User at its sole discretion. Also, you must understand that the Services provided to you by any Healthcare Provider may be based on the information provided by you. If you suffer from any kind of loss or inconvenience due to your failure to provide true, accurate, complete information, Hashi Care will not be responsible in any manner whatsoever to you or Healthcare Provider or any other party.

D. The User is responsible for maintaining the confidentiality of the User’s account access information and password, if the User is registered on the App. The User shall be responsible for all usage of the User’s account, OTP and password, whether or not authorized by the User. The User shall immediately notify Hashi Care of any actual or suspected unauthorized use of the User’s account or password. Although Hashi Care will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses to the Hashi Care due to any unauthorized use of your account.

E. User should not transfer (including by way of transfer, assignment, license, sublicense) their User name or account access information or their right to use service to any third party. However, if the User does so, the User will solely be responsible for the way anyone the User has authorized to use the service uses the Services, and for ensuring that all of such users comply with all of the terms and conditions hereto. Any violation of the Terms by any such user shall be deemed to be a violation thereof by you.

F. You undertake and confirm that your registration details, including your name, date of birth, gender, phone number, family information, health records including weight and height, personal information and email address or any other information provided by you for availing the Services, are true and accurate at all times and you undertake to update your registration details from time to time. If we become aware that the information provided by you is incorrect or false, we reserve the right to immediately cancel your registration and acceptance for registration in the future will be at our discretion.

G. Further, App may also send notifications and reminders to you with respect to bookings done or appointments scheduled by you and for the features that you may be using on the App. You hereby consent to receive such messages/emails from us. You also consent to receive communications including promotional content from Us.

5. Listing Information:

The App will display relevant information about Healthcare Providers, their profiles, qualifications, prescribed fees, contact details and various other information about them (“Listing Information”). These listings do not represent any fixed objective ranking, preference or endorsement by the Hashi Care. We do not endorse or influence control over any particular branch of medicine, theory, opinion, viewpoint or position on any topic. Hashi Care will exercise all reasonable care to ensure that the information provided in and in relation such listings is true, authentic, complete and accurate at all times. However, the Hashi Care shall not be held liable for any inaccuracies or incompleteness represented in the Listing Information despite such reasonable efforts.

6. Service Booking:

To enable you to book an appointment or services with Healthcare Provider, the App will provide you with the listings of Health Providers who may be suitable to provide you the services that you are looking for based on the information that you provide to the App including without limitation, specialty of medical professional, geographical location. From among the listings, you will need to select one. However, the listings shall be displayed and booking shall be confirmed as per availability and the App reserves the right to schedule/reschedule/cancel all such bookings and provide notification for the same.

7. Appointment:

The App provides the facility of booking an appointment with various Healthcare Providers like Doctors, Labs, and Diagnostic Centers. The App will take all reasonable measures to ensure that the User gets a confirmed appointment. However, subject to the provisions of these Terms,Hashi Carewill have no liability towards the User or any other party if such an appointment is later cancelled by the Healthcare Provider with or without notice to the User, or if the Healthcare Provider is not available at the time or place of the appointment.

No Show by User:

In the event where the User who has booked an appointment with any Healthcare Provider does not turn up at the agreed upon time and/or place without informing the Healthcare Provider in advance or cancelling or rescheduling the appointment will be considered as a ‘No Show by User’ incident. If the User does this for more than three times, Hashi Care will have a discretion to temporarily suspend or disable the User’s account and/or the services provided by the App to the User. When the Owner decides to suspend or disable User’s account and/or the services to User, the User will have an opportunity to explain to Hashi Care the reasons behind not showing up on the appointment place and/or time. User can contact Hashi Care through contact details provided in the App and this Terms for the same. After hearing the side of the User, it will be Hashi Care’s discretion to decide whether to continue with such suspension or remove it. In case where the suspension or disablement as mentioned in this provision is inflicted, it will be for the duration as may be decided by Hashi Care in their sole discretion. If the User faces any kind of claim, suit, or loss due to not showing up at the appointment place and/or time from the Healthcare Provider or any third party, Hashi Care will not have any responsibility towards the User or any other party.

8. Cancellation and Refund:

A. In the event where the Healthcare Provider cancels the appointment for which the User has paid the booking amount through the App, User will need to write to us on the contact details mentioned below in the Terms within three business days from the day of such cancellation of booked appointment. Hashi Care will look into the claim and if the incident described by the User is true then Hashi Care shall refund the booking amount paid by User through the App within next ten business days.

B. Users will not be entitled for any refunds in cases where, the Healthcare Provider is not able to meet the User at the exact time of appointment and requires the User to wait for a couple of hours not exceeding three hours, irrespective whether the User is required to wait or choose to not obtain the services from the said Healthcare Provider.

C. In case where the User does not show up for the appointment booked with the Healthcare Provider without cancelling the appointment beforehand, the booking amount will not be refunded, and it will be treated as ‘No Show by User’.

9. Limited Liability of the Owner:

The App is basically a platform connecting Users with the Healthcare Providers. The listings mentioned on the App are solely for the informational purposes of User. The App does not endorse any Healthcare Provider. When the User decides to avail the services of any Healthcare Provider or engage in any communication with any Healthcare Provider, the User does it at his/her own risk. The App is not involved in providing any healthcare service, medical advice, opinion or diagnosis. Hashi Care is merely a service facilitator and hence, is not responsible for any interactions between User and the Healthcare Provider.

Though Hashi Care takes all reasonable measures to ensure that the Healthcare Providers listed on the App are genuine and qualified, it is hereby agreed and understood that Hashi Care cannot be held liable towards any party for any or all of the following situations:

A. User’s communication or interaction with the Healthcare Provider and all situations and consequences thereto;

B. The efficiency or lack of efficiency of the Healthcare Providers in performing their Services for the Users;

C. The quality of the services given to the User or any case of negligence by the Healthcare Provider;

D. The intention or motive of Healthcare Provider in giving any opinion, suggestion, advice, treatment or any other service to the User;

E. Failure of the Healthcare Provider to provide agreed services or to provide services at agreed time and place;

F. Any inconvenience, disturbance, loss suffered by the User during the course of consultation, treatment or during the Healthcare Provider’s performance of services;

G. Effects or consequences on User’s health of any treatment, diagnosis, consultation, medicines or any other service provided by the Healthcare Provider;

H. Any misconduct, misbehavior or negligence by Healthcare provider;

I. Any breach of any applicable laws, rules, regulations by the Healthcare Provider;

J. Cancellation of appointment or no show on appointment time by the Healthcare Provider;

K. Charging of higher fees or any variation in charging of fees from what has been indicated by them on the App.

10. General Information on App not Medical Advice:

The information, content, suggestions, opinions, advice, guidance or other material generally provided or available on the App except the User’s personal interaction with the Healthcare Provider on his/her specific medical condition may be general in nature and may not accurately fit the specific circumstances or conditions of any individual. Such information is only given to assist you to find appropriate care and/or Healthcare Provider. Please note that such information provided on the App does not constitute an opinion, medical advice, or diagnosis or treatment of any particular condition. The provision of such information on the App or your use of the App does not create any sort of Patient- Medical professional relationship or privilege between the App and the User.

It is hereby expressly clarified that, the Information that you obtain or receive from Hashi Care, and its employees, contractors, partners, sponsors, advertisers, licensors or otherwise on the App is for informational purposes only. We make no guarantees, representations or warranties, whether expressed or implied, with respect to professional qualifications, quality of work, expertise or other information provided on the App. In no event shall we be liable to you or anyone else for any decision made or action taken by you in reliance on such information.

11. Area of Operation:

App may provide its services only for certain or limited cities or areas. The information relating to the areas for which the services of the App are available will be mentioned on the App. The App may add, remove or change the areas for which it provides its services in its own discretion at any time with or without notice. The App will not be responsible to you for any loss or inconvenience caused to you due to such change or removal of any area by the App.

12. Emergency Situations:

Our services are not a replacement to emergency services offered at hospitals and are not applicable if the patient is in a critical or unstable state. In case of emergency, please contact emergency services and/or rush to nearest hospital. All charges and costs towards emergency treatment to be borne by the patient.

13. Legal Compliance:

A. We will take all reasonable steps to ensure that our services are in compliance with all central and state government regulations and directives of the health ministry, Indian Council of Medical Research guidelines, the Medical Council of India, State Council, Dental Council of India, Physiotherapy Council of India and Indian Nursing Council guidelines as applicable from time-to- time. However such guidelines/directives/rules/laws from such authority/organization/institution are indicative in nature and not exhaustive. Also for App’s service of providing care providers like nurse, para medical, attendants, we will conduct appropriate background and reference checks of the care providers. If we find any problem with the background of such care provider which in our opinion may be adverse to the interests of the User, we will promptly inform the User. However the results of such verification reports are confidential and accessible only to owner and its internal staff and will not be shared with User.

B. To the extent permissible under applicable laws, despite exercising all reasonable care with regard to compliance with applicable laws, rules, regulations, if the User suffers any harm, loss or inconvenience, Hashi Care shall not be held responsible.

14. User’s Obligations:

The User agrees to abide by the following obligations. Failure to satisfy any of these obligations gives us the right to permanently suspend your account and/or claim damages for any losses that accrue to us or additional costs that may be imposed on us. You agree to comply with all applicable laws and regulations governing the downloading, installation and/or use of the App, including, without limitation, any usage rules set forth in the Terms.

You agree not to:

A. Cut, copy, paste, distribute, sell, modify, recreate, reverse engineer, post, publish or create derivative works from, transfer any information or software obtained from the App. If you want to engage in one or more such actions, prior permission from Us must be obtained.

B. use the App in any manner that may impair, overburden, damage, disable or otherwise compromise the services of the App.

C. use the App, services provided through the App, User information made available through App, or any information , material or content available on the App for any unlawful purposes or to conduct or to participate in conducting any unlawful activity, including, but not limited to, fraud, misrepresentation, cheating, defamation, money laundering or identity theft.

D. access or attempt to access the App and/or the materials or Services by any means other than through the interface that is provided by the App. The use of deep-link, robot, spider or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Application or Content, or in any way reproduce or circumvent the navigational structure or presentation of the App, materials or any Content, to obtain or attempt to obtain any materials, documents or information through any means not specifically made available through the App is prohibited.

E. use the information, content or material made available through App to abuse, harass, threaten, defame, disillusion, demean or otherwise violate the legal rights of others.

F. engage in any activity that interferes with or disrupts access to the App or the Services or the servers and networks which are connected to the App.

G. engage in any form of antisocial, disrupting, or destructive acts, including "flaming", "spamming", "flooding", "trolling", "phishing' and "griefing" as those terms are commonly understood and used on the Internet.

H. violate any applicable laws or regulations for the time being in force within or outside India.

I. violate any code of conduct or other guidelines, which may be applicable for or to any particular Service.

J. host, display, upload, modify, publish, transmit, update or share any information that: (i) belongs to another person and to which the user does not have any right; (ii) is harmful, harassing, defamatory, obscene, pornographic, pedophilic, invasive of another's privacy, hateful, objectionable, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatsoever; (iii) infringes any intellectual property right or proprietary right of any person; (iv) untrue or inaccurate in nature; (v) contains viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; (vi) threatens the unity, integrity, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any offence or prevents investigation of any offence or is insulting any other nation; (vii) violates any applicable law; (viii) impersonates others.

K. Owner, upon obtaining knowledge by itself or through any other source, shall be entitled to disable such information that is in contravention of this Terms. If we suspect any illegal, wrongful or fraudulent activity on the App by any User or Healthcare Provider, notwithstanding any other rights We may have, We reserve the right to inform the relevant government or law enforcement authorities. We will cooperate in all investigative procedures or requests for access / information initiated by any such government or law enforcement authorities.

15. Intellectual Property Rights:

A. All rights, claims, title and interest in and to the materials provided on this App, including but not limited to information, marks, documents, logos, graphics, sounds and images (the "Materials") are either owned by us or validly licensed to us or otherwise used by us as permitted under applicable laws. Through Your use of the App, by no means are any rights impliedly or expressly granted by us to you in respect of such material.

B. App and/or its licensors assert all proprietary rights in and to all names, trademarks and other intellectual properties contained on the App. Any use of our trademarks, copyright or any other intellectual property, unless otherwise authorized in written, will constitute an infringement of our trademark or copyright or any other such intellectual property right and may be actionable under the applicable laws.

C. Except as stated otherwise in the Terms all Content of App \ (including all intellectual property rights to such content) is owned exclusively by us and/or our licensors. When You use the App in accordance with this the Terms, a limited royalty-free right is granted to you by us to use the App’s content for personal and non-commercial use for the time that you are either a registered user or Healthcare Provider or for the time that You make use of the App, whichever is less. Unless explicitly stated herein, nothing in the Terms shall be construed as conferring on you any license to intellectual property rights, whether by estoppel, implication, or otherwise.

D. User Content: You agree that you are the owner of all rights including all intellectual property rights in the User Content (in case you are a Registered User) or Health Provider Content (in case you are a Healthcare provider) that you post on the App or provide to us. You hereby grant us a perpetual, non-revocable, worldwide, royalty-free license to make use of such User Content (in case You are a Registered User) or Health Provider Content (in case you are a Healthcare provider) including the right to copy, distribute, display, reproduce, modify, adapt, the User Content or Health Provider Content, as the case may be, and create derivate works of the User Content or Health Provider Content, as the case may be.

16. Disclaimers:

In addition to the limitations on liability of Owner as mentioned in other provisions of the Terms, it is hereby understood and agreed that the Owner disclaims any and all responsibilities or liabilities towards User or any third party in following situations:

A. We make no guarantees, representations or warranties, whether expressed or implied, with respect to professional qualifications, quality of work, expertise of the Healthcare Provider. The search results are based on an object computer algorithm.

B. We shall not be responsible for any breach of service or service deficiency by any Healthcare Provider.

C. We can neither assure that all transactions on the App will be completed nor do we guarantee the ability or intent of Healthcare Provider to fulfill their obligations in any transaction. We advise you to perform your own investigation prior to selecting any Healthcare Provider or Services.

D. To clarify, you understand and agree that any interactions and associated issues with the Healthcare provider(s) on the App, is strictly between you and the Healthcare Provider. You shall not hold us responsible for any such interactions and associated issues. We are not involved in the providing any healthcare or medical advice or diagnosis and hence are not responsible for any outcome between You and the Healthcare Provider You interact with. If you decide to engage with a Healthcare Provider to provide medical services to you, you do so at your own risk.

E. We may provide information to assist you in decision-making. The information and materials available through the App are for informational and educational purposes only and are not intended to constitute professional advice, diagnosis or treatment, or to substitute professional judgment. We are not responsible for the accuracy or completeness of information available from or through App. You assume full risk and responsibility for the use of information you obtain from or through this App, and You agree that we are not responsible or liable for any claim, loss, or liability arising from the use of the information. We do not recommend or endorse any Healthcare Provider or health-related products, items or services, and the appearance of materials on the App relating to any such products, items or services is not an endorsement or recommendation of them.

F. Information regarding Healthcare Provider and practice information found on the App is intended for general reference purposes only. Such information found on the App is mainly self-reported by the Healthcare Provider. Such information often changes frequently and may become out of date or inaccurate. We do not provide any advice or qualification certification about any particular Healthcare Provider. You are encouraged to independently verify any such information you see on the App with respect to a Healthcare Provider that you seek to avail services of.

G. If You rely on any of the Information provided by App, You do so solely at your own risk. The Information that you obtain or receive from Owner, and its employees, contractors, partners, sponsors, advertisers, licensors or otherwise on the App is for informational and scheduling purposes only. In no event shall We be liable to you or anyone else for any decision made or action taken by you in reliance on such information.

H. You acknowledge and confirm that we shall not be responsible for your treatment or provision of services by Healthcare Provider in any manner whatsoever.

I. We disclaim any representation and/or warranty for the security, reliability, quality, timeliness, and performance of (i) the App and its features; (ii) Healthcare Provider who responds to question of the User or who interacts privately with a User; (iii) any information, content or advice available on or received through the App (iv) access to or alteration of User content or Healthcare Provider content (v) transmissions or data and (vi) the accuracy of any content of User’s test reports or diagnosis(vii)any other matter relating to the App

J. We make no warranty or representation that any errors in the App will be corrected except as required by law.

K. We assume no responsibility and/or liability with respect to any user content, or Healthcare Provider content (as applicable) or for the consequences of you reading or relying on such content.

L. The App is provided on a "As is" and "As Available" basis. we are not liable for any technical or other operational difficulties or problems which may result in loss of your data, personalization settings or other interruptions in the features offered on the app. we are not liable for the deletion, loss, mis-delivery, timeliness or failure to store or transmit any user content or healthcare provider content, app content or your personalization settings.

M. We do not provide any guarantee and shall not be held liable or responsible for the failure to send sms or other notifications or reminders to you as a feature of the App.

N. We shall not be responsible or liable for any breach or loss of data including Personal Information caused due to events beyond our control or due to technical reasons or third party actions.

O. You acknowledge, by Your access of the App, that Your access of the App and availing of Services is at Your sole risk and You assume full responsibility for Your access and use of the App, and that Hashi Care shall not be liable for any damages of any kind related to Your access and use of them App

17. Limitation of Liability:

To the fullest extent permitted by law, in no event will Owner or its affiliates be liable for any direct, indirect, special, incidental, punitive, exemplary or consequential damages, whether or not Owner has been warned of the possibility of such damages or could have reasonably foreseen such damages.

18. Indemnification:

You hereby agree to indemnify, defend, and hold Owner and/or its affiliates, officers, directors, owners, employees, agents, representatives, harmless from and against any and all losses, damages, liabilities and costs arising from (i)Your use of the App (ii) Your breach of provisions of this Terms and (iii) any negligent or intentional wrongdoing on Your part.

19. Modification

A. We may review and update the Terms at regular intervals. It is your responsibility to review the Terms periodically. If at any time, you find any or all of the Terms to be unacceptable or do not agree with the Terms, please do not use this App. If you have any question or query related to the Terms, you can contact us at the contact details provided below in these Terms.

B. We reserve the right at any time to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. You agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

20. Termination:

We reserve the right, in the event we find out in our sole discretion that you breached the Terms, to suspend and / or terminate your user account and/or access to the Appwith or without notice to you. Any suspected illegal, fraudulent or abusive activity may be grounds for suspending and / or terminating your user account and/or your access to the App.

Upon suspension/termination of User Account and/or access to the App, regardless of the reasons therefore, your right to use the App and content and services thereof immediately ceases, and you acknowledge and agree that we may immediately deactivate or delete Your account and all related information and files in your account and/or bar any further access to such files or this App. We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension of your user account or any other actions taken by us in connection with such account termination or suspension.

Nothing in these Terms will be deemed to require us to perform any services which in our good faith judgment would be misleading, false, unlawful, inappropriate, immoral, in breach of a contract, or otherwise prejudicial to App’s interests. You acknowledge that we reserve the right to refuse service to anyone and to cancel Users' access to the App, for any reason and at any time with or without prior notice.

We respect the Intellectual property Rights of others. If you have a good faith belief that any information or content on the App is infringing on your copyrights, trademark rights or other intellectual property rights, you must notify us at the contact details given below in these Terms. We will look into the issue promptly and take necessary steps, if required.

If any dispute or disagreement arises out of or in connection with App, its services or these Terms, the Parties shall try to resolve it through fair and amicable negotiations. If it is not possible to resolve the disputes inter se, then both the Parties agree to resolve it through mediation proceeding. The mediation proceeding shall be conducted in Ahmedabad, Gujarat, India. If the dispute or disagreement cannot be resolved through mediation also, then the dispute shall be resolved through court proceedings subject to jurisdiction of Ahmedabad, Gujarat, India.

26. Severability:

If any provision of the Terms is held to be invalid, illegal or unenforceable in whole or in part for any reason, the remaining provisions shall not be affected and shall continue to be valid, legal and enforceable as though the illegal, invalid, unenforceable parts had not been included in the Terms. If a court of competent jurisdiction finds any provision of the Terms to be invalid or unenforceable, but if by limiting such provision it can become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

Headings used in the Terms are provided for convenience only and shall not be used to construe meaning or intent.

28. Waiver:

You accept and acknowledge that we shall not be liable for any loss or damage caused to the User as a result of delay or default or deficiency or failure in the Services as a result of any natural disasters, fire, riots, civil disturbances, actions or decrees of governmental bodies, communication line failures, or any other delay or default or deficiency or failure which arises from causes beyond our reasonable control (“Force Majeure Event”).
